Deutsche Gesellschaft für Gesetzgebung diskutiert EuWGB

„Vereinfachung, Konsolidierung und Kodifizierung der Rechtsvorschriften” fordert Kommissionspräsidentin Ursula von der Leyen in den politischen Leitlinien vom 18. Juli 2024. In diesem Sinne lud der Vorsitzende der Deutschen Gesellschaft für Gesetzgebung e.V. (DGG), Prof. Dr. Günther Krings MdB, am 11. September 2024 zum 33. „Berliner Forum” in den Räumlichkeiten des Deutschen Bundestages ein. Dieses dient dem Dialog über Fragen bezüglich der Effizienz von Gesetzgebung. Der Einladung folgten sowohl Abgeordnete des Deutschen Bundestages, darunter Elisabeth Winkelmeier-Becker MdB, Vorsitzende des Rechtsausschusses des Bundestages, und Ansgar Heveling MdB, Justiziar der CDU/CSU Bundestagsfraktion als auch Rechtswissenschaftlerinnen wie Frau Dr. Gisela Meister-Scheufelen zur Diskussion. Dem Thema des Abends, das Europäische Wirtschaftsgesetzbuch, kam auf Grund der Veröffentlichung des „Draghi-Berichts zur Wettbewerbsfähigkeit” am Montag, den 9. September 2024, besondere Aktualität zu. Dieser fordert zur Kodifikation und Konsolidierung von EU-Recht auf (vgl. The future of European competitiveness, Part B, Section 2, Chapter 5).

Il 28° stato virtuale per salvare l’Unione europea

Semplificazione e integrazione: un diritto commerciale unico valido dovunque nell’Ue. Si tratterebbe di un enorme passo in avanti.

L’economia europea perde colpi in modo strutturale rispetto ai suoi principali competitori mondiali, Stati Uniti, Cina e India in testa. I dati sembrano purtroppo chiari e incontrovertibili. Invertire la rotta che sta rendendo sempre più evidente e rapida questa nostra tendenza al declino deve essere l’obiettivo centrale della legislatura europea che inizia.

Per farlo con successo bisogna usare innanzitutto le potenzialità interne dell’Ue non sufficientemente sfruttate, a partire dal Mercato Unico che esiste, completamente integrato, solo in parte per via delle tendenze che hanno spinto e spingono gli Stati membri a ritardare l’integrazione in campi cruciali quali quelli dei mercati finanziari, delle Tlc, dell’energia e della difesa. In ognuno di questi campi non abbiamo un Mercato Unico bensì 27 mercati nazionali, mediamente troppo piccoli e frammentati per competere con giganti come Usa e Brics.

European business Code / Von der Leyen calls on codification

The implementation of a European Code of Business law (www.codeeuropeendesaffaires.eu) is one of the key recommendations of the report “Much more than a market” authored by Enrico Letta, President of the Jacques Delors Institute and former Italian Prime Minister, to strengthen the European single market.

It is a promising development that the newly re-elected President of the European Commission, Ms. Ursula von der Leyen, has included Mr. Letta’s report suggestions in her roadmap, in the section called “Facilitating business activity”. She has further expanded on these suggestions by introducing the concept of codification:

“On this basis, we will make proposals to simplify, consolidate and codify legislation to eliminate any overlaps and contradictions while maintaining high standards. We will also address the patchwork of national regulations that makes doing business in different EU countries more complicated. We will make it easier for innovators to succeed by reducing the cost of failure. To support this, I will propose a new EU-wide legal status to help innovative companies grow. This will take the form of a so-called “28th regime” to allow companies to benefit from a simpler, harmonized set of rules in certain areas”.

European business Code / Ursula von der Leyen’s guidelines

The implementation of a European Code of Business law (www.codeeuropeendesaffaires.eu) is one of the key recommendations of the report “Much more than a market” authored by Enrico Letta, President of the Jacques Delors Institute and former Italian Prime Minister, to strengthen the European single market.

With the scientific support of the Henri Capitant Association, and the support of numerous European foundations (in France, the Foundation for Continental Law, the Robert Schuman Foundation, and EuropaNova), the objective of the European Business Code project is to address, whenever feasible, the fragmentation of European commercial legislations. This fragmentation hinders the ability of small and medium-sized enterprises to thrive within the internal European market, thus affecting the economic competitiveness of the Union.

In his report, Enrico Letta demonstrates that it is possible to make useful progress within the framework of an 28th optional regime with the creation of instruments such as a unique status for European SMEs (the Simplified European Company), the euro bond, euro guarantee, euro security, the European loan contract, and the European insurance contract.

Ursula von der Leyen apoya la codificación

La creación de un Código Europeo de Negocios, Comercio y Sociedades es una de las recomendaciones clave del informe “Mucho más que un mercado” de Enrico Letta, Presidente del Instituto Jacques Delors y antiguo Presidente del Consejo italiano.

Es gratificante que la recién elegida Presidenta de la Comisión Europea, Ursula von der Leyen, haya adoptado en gran medida las propuestas del informe del Sr. Letta en el capítulo “Facilitar la actividad empresarial” de sus directrices. Ella llama a la idea del Código Económico Europeo por su nombre:

“Sobre esta base, formularemos propuestas para simplificar, consolidar y codificar la legislación con el objetivo de eliminar cualquier solapamiento o contradicción, manteniendo al mismo tiempo normas estrictas. También abordaremos el mosaico de normativas nacionales que hacen difíciles las actividades empresariales en diferentes países de la UE. Facilitaremos que los innovadores tengan éxito reduciendo los costes en caso de que no lo logren. A tal fin, propondré un nuevo estatuto jurídico a escala de la UE para ayudar a las empresas innovadoras a crecer, que adoptará la forma del llamado “28º régimen” y permitirá a las empresas beneficiarse de un conjunto de normas más sencillo y armonizado en determinados ámbitos”.
